Proposed Rules Changes
The Governance Committee has submitted two recommendations for revision of the current Landings Association Rules and Regulations. These changes do not originate with staff but are the results of observations and concerns reported by our residents. In accordance with our procedure, the proposed Rules are submitted to the community for comment. The Rules involved pertain to unaccompanied guests and flags.
Section B, subsection 2 of our Rules provides that all owners/residents and guests must comply with all Rules and Regulations governing the specific amenity. The proposed revision makes residents responsible for their guests and provides all guests other than the resident’s immediate family must be accompanied by a resident in good standing while using any of the Association amenities. Included as amenities are the Marinas, docks, piers, Athletic complex, parks, and common areas and buildings.
The revision is intended to meet our expectations of security. Residents have the right to expect that those who are out and about belong here. The revision enables TLA to hold the resident responsible for misconduct of the guest. It is not the intent to have Security randomly stop people and to ask for identification. It does enable Security to hold the resident responsible for guest misconduct; thereby establishing responsibility.
Here is the proposed Rule:
“All owners/residents and guests must comply with the rules and regulations governing the specific amenity, and residents are responsible for their guests. All guests other than the sponsoring resident’s immediate family (parents, siblings, children, and/or grandchildren) must be accompanied by a resident in good standing while using any Association amenity, including Marinas, docks, piers, Athletic Complex, parks, common areas, and buildings.”
Over the past several weeks, residents have reported seeing political flags at residences in our community. Our Rule concerning signs does not specifically address flags. One interpretation of the sign Rule would ban all flags other than the American flag.
We believe it is in the best interests of the community to clarify our Rules as they pertain to flags. The proposed Rule concerning flags takes into account the current practices in the community concerning the types of flags which are flown. While we believe everyone knows what a flag is, for clarity we utilize the definitions: a piece of cloth or similar material, typically oblong or square, attachable by one edge to a pole or rope and used as the symbol or emblem of a country or institution or as a decoration during public festivities.
The current circumstances require that we take this action. While we wish we did not have to create another Rule, we believe it is the prudent and necessary action.
Here is the proposed Rule:
“For purposes of this Rule, signs shall not be construed to include flags. Only the following categories of flags are permitted: the American flag; flags of the 50 U.S. states and its territories; official country flags; colleges’ and universities’ flags; professional sports team’s flags; flags of the branches of the US military; and celebratory flags commemorating holidays, the four seasons of the year, and birthdays. The Architectural Guidelines require all flag poles be approved in advance by the ARC.”
